Seems like the guy who wrote that agreement has way too much time on his hands!
For one thing, when you buy software at a store, yiou have a contract with gthe store itself, not the software manufacturer. The reseller has purchased the product to sell to you. Therefore the store is resplonsible for exchanges, refunds etc., not the manufacturer. State laws govern this practice. Store policies also regulate it.
MicroCenter gives refunds and exchanges on open boxes of software in the first 7 days. Most stores will give an exchange on an open box just to remain in the competition with other stores.
Manufacturers that sell boxed versions of their products make very little profit on them. They must give huge discounts to stores in order to compete with the limited shelf space availability. Naturally, a store is going to sell products it can make the most profit on. That's why there is such a limited selection of software in retail stores. The money for vendors is in the shareware market place, not in stores.
It cost's lots of dough to press off thousands of quality CD's, shipping and handling, containers and packaging, taxes, labor costs, insurances, etc etc etc. Wheras a download is relatively inexpensive for the vendor.
Heli, the only software I ever bought in a store was tax stuff and my first antivirus app because I had a virus and couldn't download at the time!
CompUSA doesnt take any software or game which has been onpened just because its normal, if you have a businnes you dont want to lose money they but the software and when you buy it you are dealing with the polices of the STORE "just like TonyT said " not the software license. That police was stablish because PEOPLE bought the softwares and games they made a copy and they just return it , humm free games and softwares ( its not everyone but most of the people ) so thats why some stores doesnt take and software or games back .
