I've seen TV ads from a local DSL provider claiming that their ADSL is faster than cable. Their cap is 768 kbps down. I have @home here and routinely see > 3000 kbps. I wrote to ask how they can make these claims. Here it is...

Thank you for your interest about our ADSL service.
As to your reports that we are falsely advertising our product let me
explain a little bit about how we come to state that ADSL is faster then
most Cable connections.
As you stated you get great upload and download speeds with your Cable
connection and that our ADSL has a cap speed on them. We have found that
people who get great speeds from Cable also experience a slow down of their
connection as more people get on a Cable service in their area. This is
because Cable is shared bandwidth and a shared line. ADSL is not these
things. With ADSL you have your own connection to the internet and never
share this circuit with anyone. So your speeds will remain a constant no
matter how many people in your area have ADSL. So our website stating that
our ADSL is faster than Cable is due to research of current cable customers
speeds in an area where there are a lot of cable users on the same service.
